BENEFITS
Maximizing Your Workers' Compensation Benefits
- Whether you work full time, part time, you are covered. At Lee Partners Law: Injury Attorneys we aggressively defend your right to these benefits, pushing back against billion-dollar insurance companies determined to limit or deny your claims.
Medical Care
Under Labor Code Section 4600, your employer is obligated to provide all medical care reasonably required to cure or relieve your injury's effects. This includes:
- Serious Injuries: Broken bones? Surgery is covered. Lost limb? You're entitled to prosthetics.
- Transportation: If you cannot drive due to your injury, transportation must be provided.
- Therapies: Back strain or muscle injuries? You have the right to necessary physical therapy.
- Stress or Psych: Has your employer caused you stress or psych issues? You are entitled to therapy.
By law, medical coverage continues for your lifetime for the injured body parts. However, insurance companies often attempt to obstruct your access to benefits. Lee Partners Law aggressively removes these obstacles, ensuring you get lifelong care without unnecessary delays or denials.
2. Temporary Disability (TD) Benefits
- If your injury prevents you from working temporarily, you’re entitled to receive Temporary Disability benefits, typically up to 104 weeks under California law. Insurance carriers must begin payments within 14 days. Failure to do so results in penalties, increasing your benefits by up to 25%, depending on the insurance company's conduct.
- If your injury is severe or catastrophic, special exceptions might extend your benefits beyond the typical limit. At Lee Partners Law we make sure you're fully compensated—and if an insurance company acts in bad faith, we hold them accountable for penalties.
3. Permanent Disability (PD) Benefits
- When your medical condition stabilizes—legally known as reaching Maximum Medical Improvement (MMI)—you're eligible for Permanent Disability benefits. These benefits provide compensation for permanent impairments affecting each injured body part.
- Medical experts determine your impairment rating (Whole Person Impairment or WPI) using the AMA Guides (5th Edition). This rating is then adjusted based on your age, occupation, and injury type. Your final Permanent Disability rating can range from 0% to 100%.
- Lee Partners Law aggressively advocates to ensure your impairment rating—and thus your compensation—is maximized. We achieve this by:
- Expertly challenging medical evaluations.
- Ensuring strict adherence to AMA guidelines.
- Strategically navigating the rating formula to maximize your financial benefits.
While many attorneys shy away from confronting medical professionals directly, Lee Partners fearlessly
advocates for your maximum entitlement.
4. Lifetime Medical Care
- The law guarantees lifetime medical care for your work-related injuries. Insurance companies often attempt to limit these benefits. Lee Partners Law is dedicated to breaking down these roadblocks and ensuring continuous, comprehensive medical care for as long as you need it.
- 5 Death Benefits:
- If a worker tragically dies due to a work-related injury or illness, the worker’s dependents are entitled to death benefits. These include reasonable funeral and burial expenses (up to an amount set by law) and ongoing financial support payments to a spouse, children, or other dependents. The total amount of death benefits depends on the number of dependents. Workers’ comp death benefits are crucial to help families who lose a breadwinner in a workplace accident.
6. Supplemental Job Displacement Benefits (SJDB)
Once you have permanent disability, if your employer does not offer you alternative or modified work paying at least 85% of your pre-injury wages within 60 days of the permanent disability, you're entitled to Supplemental Job Displacement Benefits (SJDB) under Labor Code Section 4658.7. These benefits include:
- A one time $5,000.00 cash payment.
- Funding for vocational retraining, skill enhancement, and education.
- Costs for tuition, retraining courses, or certification programs.
- Expenses for skill enhancement, training, and retraining.
SJDB helps you re-enter the workforce by providing essential resources to secure employment suitable for your post-injury capabilities.
